The Town of Oakville has received a complete application by Garden Residences Corporation for a proposed plan of subdivision.
There is an official plan and zoning by-law amendment application currently under review by the town to change the site-specific exception policies applying to the lands to allow for 3 blocks of four storey back-to-back townhouses with rooftop amenity and a mixed-use building along Lakeshore Road West for a total of 48 units, and approximately 194 square metres of ground floor commercial.
The purpose of the Plan of Subdivision application is to permit the proposed development to proceed as a common element condominium, as the site is not currently within a Block in a Plan of Subdivision.
The effect of the application is to allow common element tenure.
The subject lands are located on the northeast corner of Garden Drive and Lakeshore Road West and is municipally known as 105 -159 Garden Drive.
This land is also subject to Official Plan Amendment (File No. OPA 1617.47) and Zoning By-law Amendment (Z.1617.47) application.
If a person or public body does not make oral submissions at a public meeting, if one is held, or make written submissions to Council c/o the Town Clerk at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 (Dropbox is located in front of Town Hall) or at townclerk@oakville.ca in respect of the proposed plan of subdivision before the approval authority gives or refuses to give approval to the draft plan of subdivision, the person or public body is not entitled to appeal the decision of the Director of Planning and Development to the Ontario Land Tribunal.
If a person or public body does not make oral submissions at a public meeting, if one is held, or make written submissions to Council c/o the Town Clerk at the Town of Oakville, Clerk’s department, in respect of the proposed plan of subdivision before the approval authority gives or refuses to give approval to the draft plan of subdivision, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
