Notice of passing of a proposed Official Plan Amendment and proposed Zoning By-law Amendment 210 and 374 Burnhamthorpe Road West Eno Investments Limited and Ankara Realty Limited OPA1317.07 and Z.1317.07

On Monday, December 16, 2024, Town Council passed By-law 2024-170, which adopted an Official Plan Amendment to 1984 Oakville Official Plan (North Oakville East Secondary Plan), under section 17(23), of the Planning Act, R.S.O. 1990, c. P.13, as amended and passed Zoning By-law 2024-172 under section 34 of the Planning Act.

The purpose and effect of the Official Plan Amendment, By-law 2024-170, is to modify Schedule NOE1, Community Structure and relocate the Neighbourhood Central Activity Node to the intersection of Carding Mill Trail and William Halton Parkway.

The purpose and effect of the Zoning By-law Amendment, By-law 2024-172 is to rezone the site from Future Development (FD) to General Urban (GU), Suburban (S), Neighbourhood Centre (NC), Park (P), Institutional (I), Natural Heritage System (NHS) and Stormwater Management Facility (SMF) zones with site-specific regulations.  

Access to the site will be from William Halton Parkway, Burnhamthorpe Road West, and the abutting subdivisions to the east and west and also from the south on Carding Mill Trail.

Council’s decision reflects that the comments from the public have been appropriately addressed.

The subject land is also subject to the town-initiated Neyagawa Urban Core Area review (File No.: 42.15.60). A Statutory Public Meeting on this matter was held at the November 25, 2024 Planning and Development Council meeting; wherein a draft of a proposed Official Plan Amendment was presented.

Any appeals to the proposed official plan amendment or zoning by-law amendment must be filed with the Town Clerk, 1225 Trafalgar Road, Oakville, ON, L6H 0H3, setting out the reasons for the appeal and the specific part of the proposed official plan amendment to which the appeal applies; and must be accompanied by the fee required by the Ontario Land Tribunal. Copies of the appeal forms are available from the Ontario Land Tribunal website.

The proposed official plan amendment is exempt from approval by the Regional Municipality of Halton. The decision of the Town of Oakville Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Only individuals, corporations or public bodies may appeal a decision of the Town of Oakville Council or a by-law to the Ontario Land Tribunal.  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted or before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
