For reasons set out in the Planning and Development Council Staff Report dated June 25, 2024, Council has decided to refuse the application for a zoning by-law amendment and draft plan of subdivision submitted by Spruce Rose Inc. under sections 34 and 51 of the Planning Act, R.S.O. 1990, c. P.13, as amended on July 8, 2024.

The purpose and effect of the application is to create seven residential lots and one block for proposed daylight triangle and rezone the subject lands from Community Use (CU) to Residential Low 5 (RL5) with special provisions to implement the development.

The subject land is located southeast corner of Reynolds Street and Spruce Street.

Council’s decision reflects that the comments from the public have been appropriately addressed.

Any appeals to this application must be filed with the Town Clerk, 1225 Trafalgar Road, Oakville, ON, L6H 0H3, setting out the reasons for the appeal, and the specific part of the proposal to which the appeal applies; and must be accompanied by the fee required by the Ontario Land Tribunal. A copy of the appeal form is available from the Ontario Land Tribunal website.

A specified person or public body that requested this application from the Town of Oakville may appeal the refusal to the Ontario Land Tribunal in respect of all or any part of the application by filing a notice of appeal with the Town Clerk.

The decision of Council is final if a notice of appeal is not received before or on the last day to appeal.
