Council has decided to refuse the applications for a zoning by-law amendment and draft plan of subdivision submitted by MacDonald Rose Inc. under sections 34 and 51 of the Planning Act, R.S.O. 1990, c. P.13, as amended on March 3, 2024.
The purpose and effect of these applications is to create two blocks and a change in zoning to permit the development of 11 townhouse dwelling units with access to Macdonald Road and Reynolds Street.
Council refused this application for the reasons set out in the Staff Report presented to Council.
Council’s decision reflects that the comments from the public have been appropriately addressed.
Any appeals to this application must be filed with the Town Clerk, 1225 Trafalgar Road, Oakville, ON, L6H 0H3, setting out the reasons for the appeal, and the specific part of the proposal to which the appeal applies; and must be accompanied by the fee required by the Ontario Land Tribunal. A copy of the appeal form is available from the Ontario Land Tribunal website.
A person or public body that requested this application from the Town of Oakville may appeal the refusal to the Ontario Land Tribunal in respect of all or any part of the application by filing a notice of appeal with the Town Clerk.
No person or public body shall be added as a party to the hearing of the appeal unless, before application was refused, the person or public body made oral submission at a public meeting if any, or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
The decision of Council is final if a notice of appeal is not received before or on the last day to appeal.
