On Tuesday May 21, 2024, Town Council passed By-laws 2024-057 and 2024-058, which adopted Official Plan Amendment 67 and 331, under section 17(23), of the Planning Act, R.S.O. 1990, c. P.13, as amended.

These amendments enable the delegation of approvals for minor zoning by-law amendments meeting the criteria applicable to minor variances, for the purpose of accommodating new dwelling units greater than the current number of dwelling units that exist on a site, including affordable housing and modular housing, to town staff. The purpose of the amendments is to accelerate the delivery of housing. 

The proposed Official Plan Amendments will update the town's implementation policies in both the Livable Oakville Plan and 1984 Oakville Official Plan (North Oakville Secondary Planning Area) to enable the delegation of authority of these matters and streamline development application review requirements including notice provisions in a manner consistent with the process applicable to minor variances.

The Official Plan Amendments apply to all lands within the Town of Oakville.

Council’s decision reflects that the comments from the public have been appropriately addressed.

Any appeals to the proposed official plan amendment must be filed with the Town Clerk, 1225 Trafalgar Road, Oakville, ON, L6H 0H3, setting out the reasons for the appeal, and the specific part of the proposed official plan amendment to which the appeal applies; and must be accompanied by the fee required by the Ontario Land Tribunal. A copy of the appeal form is available from the Ontario Land Tribunal website. 

The proposed official plan amendment is exempt from approval by the Regional Municipality of Halton. The decision of the Town of Oakville Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Only individuals, corporations or public bodies may appeal a decision of the Town of Oakville Council to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. 

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
