On Monday, May 6, 2024, Town Council passed By-laws 2024-051 and 2024-052, which adopted Official Plan Amendments 65 and 330, under section 17(23), of the Planning Act, R.S.O. 1990, c. P.13, as amended.

This notice describes town-initiated Official Plan Amendments that relate to additional dwelling units. 

These initiatives are being undertaken to address a Council motion responding to the Federal Government’s Housing Accelerator Fund program.

Additional dwelling units

This initiative proposes Official Plan Amendments to the following documents:

The purpose of the Official Plan Amendments is to modify the policies of these documents to permit additional dwelling units in alignment with Section 16(3) of the Planning Act.

(Note: Current in-effect zoning regulations permit up to three dwelling units per property containing a detached house, semi-detached house, and townhouse as required by Section 35.1 of the Planning Act. The proposed official plan amendments would recognize existing permissions only). 

The effect of the proposed amendments to the Livable Oakville Plan and North Oakville East Secondary Plan will:

  • update terminology to permit additional dwelling units subject to regulations of the Zoning By-law;
  • ensure additional dwelling units do not count toward the calculation of density;
  • enables guidance material to be developed; 
  • ensures policies conform to provincial legislation; and,
  • align the Livable Oakville Plan and the North Oakville East Secondary Plan policies.

Council’s decision reflects that the comments from the public have been appropriately addressed.

Pursuant to section 17(24.1) and (24.1.1) of the Planning Act, R.S.O. 1990, c. P.13, this decision is not subject to appeal except by the Minister of Municipal Affairs and Housing.

The proposed official plan amendment is exempt from approval by the Regional Municipality of Halton. The decision of the Town of Oakville Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
