You are invited to provide input as it relates to this application submitted under Section 36 of the Planning Act to remove Holding symbols ‘H53’ and ‘H55’ from Zoning By-law 2009-189, as amended, applicable to the lands identified in the map below.
A “H” holding symbol is a mechanism to ensure that certain conditions are met prior to the development of the lands proceeding in accordance with the approved zoning. If the conditions are met, the town is required to remove the holding symbol upon application by the landowner, by passing a by-law under Section 36 of the Planning Act.
Holding Provision Number ‘H53’ requires that the following conditions shall first be completed to the satisfaction of the Town of Oakville:
- That the Sixth Line Road works and associated storm sewer (located on town lands abutting the subject lands to the east) that affects the subject property is constructed, certified, stabilized, operational and in public ownership in accordance with town approved engineering drawings, MOECC Environmental Compliance Approval (ECA and Conservation Halton permits) to the satisfaction of the Town of Oakville, Regional Municipality of Halton, and Conservation Halton.
- That the storm sewer works within the neighbouring Argo West Morrison Creek Development (Street E) is constructed and operational.
Holding Provision Number ‘H55’ requires that the following condition shall first be completed to the satisfaction of the Town of Oakville:
- That the external local watermains and sanitary sewer extensions that are proposed on the lands adjacent to the subject lands and that are required to service this property have been constructed and are operational to the satisfaction of the Region of Halton or that alternative provisions have been made by the owner for the design and construction of the external watermain and sanitary sewer extensions to the satisfaction of the Region of Halton.
The Commissioner of Community Development, or their designate, will be deciding on the application to remove the holding provisions on Monday, May 27, 2024.
Although there are no third-party rights of appeal on the removal of the holding symbol, you are entitled to notice and may make written submissions before the by-law is passed. Any submission should be forwarded to the Commissioner c/o the Town Clerk at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 (Dropbox is located in front of Town Hall) or at TownClerk@oakville.ca. Written submissions should be submitted no later than noon on Monday, May 27, 2024.
All submissions should include the full name and address of the author.
