On Monday, August 14, 2023, Town Council passed By-law 2023-070, which adopted Official Plan Amendment 57, under section 17(23), of the Planning Act, R.S.O. 1990, c. P.13, as amended and passed Zoning By-law 2023-071 under section 34 of the Planning Act.
The purpose of the applications is to amend the Town’s Official Plan and Zoning By-law to permit a site-specific maximum building height of six storeys. The proposed Zoning By-law Amendment would implement the proposed development and introduce regulations relating to the maximum building height for the subject lands.
The effect of the applications would be to permit a new six-storey seniors’ residential mixed-use facility, containing 159 dwelling units with retail and commercial units along the ground floor.
The subject lands are located on the south side of Lakeshore Road West, east of Jones Street, west of Nelson Street and north of Marine Drive.
At this time there are no other applications, under the Planning Act, R.S.O. 1990, c. P.13, as amended, pertaining to the subject lands.
Council’s decision reflects that the comments from the public have been appropriately addressed.
Any appeals to the proposed official plan amendment or zoning by-law amendment must be filed with the Town Clerk, 1225 Trafalgar Road, Oakville, ON, L6H 0H3, setting out the reasons for the appeal and the specific part of the proposed official plan amendment to which the appeal applies; and must be accompanied by the fee required by the Ontario Land Tribunal. Copies of the appeal forms are available from the Ontario Land Tribunal website.
The proposed official plan amendment is exempt from approval by the Regional Municipality of Halton. The decision of the Town of Oakville Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.
Only individuals, corporations or public bodies may appeal a decision of the Town of Oakville Council or a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted or before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
