The Commissioner of Community Development passed Temporary Use By-law 2023-007 under section 39, of the Planning Act, R.S.O. 1990, c. P.13, as amended on February 2, 2023.
The purpose and effect of Temporary Use By-law 2023-007 is to amend the Zoning By-law for a new use on a temporary basis for a period of up to 3 years to permit a single storey trailer, approximately 256 square metres in size, with 18 temporary parking spaces, to be used as an administrative office for Mattamy Homes to support warranty programs for new subdivisions in North Oakville.
The subject land is located on the north side of Burnhamthorpe Road West, west of Sixth Line.
At this time there are no other applications, under the Planning Act, R.S.O. 1990, c. P.13, as amended, pertaining to the subject lands.
The Commissioner of Community Development has fully considered all written and oral submissions related to this matter and that these comments have been appropriately addressed.
Any appeals to the proposed by-law amendment must be filed with the Town Clerk at 1225 Trafalgar Road, Oakville, ON, L6H 0H3; must set out the reasons for the appeal; and must be accompanied by the fee required by the Ontario Land Tribunal. A copy of the appeal form is available from the Ontario Land Tribunal.
Only individuals, corporations and public bodies may appeal a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Commissioner of Community Development c/o the Town Clerk (at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 or at TownClerk@oakville.ca) or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
