Notice of Passing
Town-wide Official Plan Amendments
Pre-consultation and Complete Applications Submission Requirements and Alternative Notice Procedures (Bill 109)
42.24.26, town-wide

On Monday, December 5, 2022, Town Council passed by-law 2022-122 and 2022-123, which adopted Official Plan Amendments 329 and 53, under section 17(23), of the Planning Act, R.S.O. 1990, c. P.13, as amended.

The purpose and effect of these Official Plan Amendments is to implement changes made to the Planning Act resulting from Bill 109, More Homes for Everyone Act, 2022.

Schedule 5 of the Bill made changes to the Planning Act by providing rules respecting when municipalities are required to refund fees in relation to processing times of development applications.

These Official Plan Amendments respond to these changes by updating the town’s implementation policies in both the Livable Oakville Plan and 1984 Oakville Official Plan (North Oakville Secondary Planning Area). The amended policies would put into effect the existing town practice to ensuring that an applicant conducts a Public Information Meeting (PIM) prior to the submission of a proposed official plan amendment, zoning by-law amendment, or draft plan of subdivision.

These Official Plan Amendments apply to all lands within the Town of Oakville.

Council’s decision reflects that the comments from the public have been appropriately addressed.

Any appeals to the proposed official plan amendments must be filed with the Town Clerk, 1225 Trafalgar Road, Oakville, ON, L6H 0H3, setting out the reasons for the appeal, and the specific part of the proposed official plan amendments to which the appeal applies; and must be accompanied by the fee required by the Ontario Land Tribunal. A copy of the appeal form is available from the Ontario Land Tribunal website.

The proposed official plan amendments are exempt from approval by the Regional Municipality of Halton. The decision of the Town of Oakville Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Only individuals, corporations or public bodies may appeal a decision of the Town of Oakville Council to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

The public may view planning documents and background material on the town's Bill 109 page.

The personal information accompanying your submission is being collected under the authority of the Planning Act, R.S.O. 1990, c. P.13, as amended, and can form part of the public record which may be released to the public.
