Council has made a decision to refuse the application for an official plan amendment and zoning by-law amendment submitted by Empress Capital Group Ltd. under sections 22 and 34, of the Planning Act, R.S.O. 1990, c. P.13, as amended on July 6, 2020.
The purpose of the proposed Official Plan Amendment is to create a site specific exception to the Core Commercial designation to allow a hotel as a permitted use. The purpose of the Zoning By-law Amendment is to create a site specific Special Provision to permit the proposed hotel use and to allow site specific standards to implement the proposed site layout.
Council was concerned with the safety of the travelling public with the proposed access and egress plan which appeared to rely on U-Turns at a very busy intersection and with the proposed reduced parking standard for this hotel especially in the absence of a Shared Access and Parking Agreement with the neighbouring property. Council’s decision reflects that the comments from the public were fully considered by Council and have been appropriately addressed.
Any appeals must be filed with the Town Clerk at 1225 Trafalgar Road, Oakville, ON, L6H 0H3; must set out the reasons for the appeal; and must be accompanied with a certified cheque or money order in the amount of $300.00 payable to the Minister of Finance. A copy of the appeal form is available from the Local Planning Appeal Tribunal website.
A person or public body that requested an amendment to the official plan of the Town of Oakville may appeal the refusal of the requested amendment to the Local Planning Appeal Tribunal in respect of all or any part of the requested amendment by filing a notice of appeal with the Town Clerk.
No person or public body shall be added as a party to the hearing of the appeal unless, before the requested official plan amendment was refused, the person or public body made oral submission at a public meeting if any, or written submissions to the council or, in the opinion of the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.
The decision of Council is final if a notice of appeal is not received before or on the last day to appeal.
